EPC Basis of Review (BOR) Chapter V Final Rule Adoption
On Thursday, May 20, 2021, the EPC held a Public Hearing in accordance with Section 1-2.71, Rules of the EPC to consider and adopt proposed amendments to Chapter V f the "Basis of Review for Authorization of Activities Pursuant to Chapter 1-11 - Wetlands" (BOR).

On Thursday, May 20, 2021, the Environmental Protection Commission (EPC) held a Public Hearing in accordance with Section 1-2.71, Rules of the EPC to consider and adopt proposed amendments to Chapter V of the "Basis of Review for Authorization of Activities Pursuant to Chapter 1-11 - Wetlands" (BOR). The Commission adopted the proposed rule amendment and the rule is effective as of May 25, 2021.
Chapter V of the BOR specifies the technical criteria for the Miscellaneous Activities in Wetlands (MAIW) permitting program. This includes construction and non-construction related activities such as boardwalks, docks, rip rap, other shoreline activities, and whole lake treatment. MAIWs are wetland permits for development which is of nominal consequence to the wetland and do not require a reasonable use analysis or mitigation.
